  • Professional ratings, reviews, and testimonial systems
  • Portfolio galleries and project showcase capabilities

Marketplace Services:

  • Job posting system with file upload capabilities for project specifications
  • Quote request and proposal management tools
  • Credit-based transaction processing system
  • Secure communication channels between users
  • Professional portfolio management with image and video uploads
  • Project management and milestone tracking tools
  • Dispute resolution and mediation services

Account Management:

3. ELIGIBILITY AND ACCOUNT REGISTRATION

3.1 General Eligibility

To use our services, you must:

  • Be at least 18 years of age (or the age of majority in your jurisdiction)
  • Have the legal capacity to enter into binding agreements
  • Provide accurate and complete registration information
  • Comply with all applicable laws and regulations in your jurisdiction
  • Not be prohibited from using our services under applicable law
  • Not have been previously suspended or banned from our platform

3.2 Professional User Requirements

Drone professionals must additionally:

  • Hold valid commercial drone operation licences as required by their jurisdiction’s aviation authority

  • Comply with all aviation regulations and safety standards
  • Provide accurate professional credentials and certification information
  • Maintain good standing with relevant professional and regulatory bodies
  • Possess the skills, qualifications, and equipment necessary to provide advertised services

3.3 Account Registration Process

Registration Requirements:

  • Complete our two-step registration form with accurate information
  • Verify your identity through our OTP (One-Time Password) system via SMS
  • Provide valid contact information including email address and phone number
  • Accept these Terms of Service and Privacy Policy
  • Complete any additional verification steps as required
  • Agree to receive essential service communications

Account Security:

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must use strong passwords and enable two-factor authentication where available
  • You must notify us immediately of any unauthorised use of your account
  • We reserve the right to suspend accounts showing suspicious activity
  • You are liable for all activities conducted under your account
  • You must not share your account with others or allow others to access your account

3.4 Profile Completion and Maintenance

  • Users are responsible for keeping their profile information up to date
  • False or misleading information may result in account suspension or termination

4. PROFESSIONAL VERIFICATION AND DPN BADGE

4.1 Verification Process

Our DPN Badge programme provides enhanced credibility for verified professionals:

Document Requirements:

  • Valid pilot licence issued by the relevant aviation authority
  • Current commercial operation permits or certificates
  • Insurance documentation demonstrating adequate coverage
  • Additional regulatory documents as required by jurisdiction
  • Government-issued identification for identity verification
  • Professional references or testimonials (where applicable)

Verification Standards:

  • All documents undergo manual review by our verification team
  • Documents must be current, valid, and issued by recognised authorities
  • Additional verification may be required based on jurisdiction-specific regulations
  • We reserve the right to request supplementary documentation
  • Third-party verification services may be used to confirm document authenticity
  • Verification decisions are made at our sole discretion

4.2 Badge Benefits and Responsibilities

Ongoing Obligations:

  • Maintain insurance coverage and professional standards
  • Report any regulatory violations or safety incidents

4.3 Verification Limitations and Disclaimers

  • Verification confirms document authenticity but does not guarantee professional competence
  • Users remain responsible for verifying credentials independently
  • DPN is not liable for the accuracy of professional services provided
  • Verification status may be revoked if requirements are no longer met
  • Verification does not constitute endorsement of professional services
  • DPN disclaims responsibility for professional misconduct or negligence

5. PLATFORM USAGE RULES AND CONDUCT

5.1 Permitted Uses

You may use our platform to:

  • Search for and contact drone professionals
  • Post legitimate job opportunities and service requests
  • Engage in lawful commercial transactions
  • Communicate with other users through our platform
  • Leave honest reviews and ratings for services received

5.2 Prohibited Activities

You must not:

Content Violations:

  • Post false, misleading, or fraudulent information
  • Upload content that violates intellectual property rights
  • Share inappropriate, offensive, or harmful material
  • Impersonate other individuals or entities
  • Post content containing viruses, malware, or harmful code
  • Upload illegal or copyrighted material without authorisation

Platform Misuse:

  • Attempt to circumvent our security measures or verification processes
  • Use automated systems or bots to access our services
  • Interfere with the normal operation of our platform
  • Harvest user data or contact information for unauthorised purposes
  • Attempt to reverse engineer or hack our platform
  • Create multiple accounts to circumvent restrictions or bans

Commercial Restrictions:

  • Provide drone services without proper licences or authorisation
  • Violate aviation regulations or safety standards
  • Engage in price manipulation or unfair competitive practices
  • Use our platform for illegal activities or fraud
  • Advertise services outside your areas of qualification
  • Engage in predatory pricing or dumping practices

Communication Abuse:

  • Send spam, unsolicited communications, or harassment messages
  • Share contact information to circumvent our platform
  • Engage in discriminatory or abusive behaviour towards other users
  • Use our platform for marketing unrelated services or products
  • Solicit users for competing platforms or services

5.3 User Conduct Standards

  • Treat all users with respect and professionalism
  • Respond promptly to legitimate inquiries and communications
  • Honour commitments made through our platform
  • Maintain confidentiality of client information and project details
  • Report suspected violations of these Terms to our support team
  • Comply with applicable professional codes of conduct

5.4 Enforcement and Penalties

  • We reserve the right to investigate suspected violations
  • Violations may result in warnings, account suspension, or termination
  • We may remove content or disable features without prior notice
  • Serious violations may be reported to relevant authorities
  • Users may appeal enforcement actions through our dispute resolution process

6. CREDIT SYSTEM AND PAYMENTS

6.1 Credit-Based Transactions

Credit Purchases:

  • Credits are purchased through our secure payment system
  • Payment processing is handled by third-party providers (PayFast and PayPal)
  • All credit purchases are final and non-refundable, except as required by applicable consumer protection legislation (including the South African Consumer Protection Act 68 of 2008)
  • Credits do not expire and remain valid indefinitely
  • Credit prices are displayed clearly before purchase
  • Bulk credit purchases may be available at discounted rates

Credit Usage:

  • Credits are consumed for specific platform actions such as job postings and enhanced features
  • Credit costs for various services are clearly displayed before transaction
  • Insufficient credit balances will prevent access to premium features
  • Credit usage history is maintained in your account dashboard
  • Credits cannot be transferred between accounts
  • Credits have no cash value and cannot be redeemed for money

6.2 Payment Processing

  • Bank transfers (where available)

  • No Refunds: All credit purchases are final and non-refundable, except as required by applicable consumer protection legislation (including the South African Consumer Protection Act 68 of 2008)
  • Credits remain valid indefinitely and do not expire
  • Unused credits retain their full value and can be used for future services
  • Exceptional circumstances may be considered on a case-by-case basis at our sole discretion
  • Refunds for technical errors or system failures may be provided
  • Chargebacks or payment reversals may result in account suspension

6.5 Taxation

  • Prices include applicable VAT/GST where required
  • Users are responsible for their own tax obligations

7. USER CONTENT AND INTELLECTUAL PROPERTY

7.1 User-Generated Content

Content Ownership:

  • You retain ownership of content you post on our platform
  • By posting content, you grant DPN a non-exclusive, royalty-free, worldwide licence to use, display, distribute, and promote your content
  • This licence continues for the duration of your account and reasonable time thereafter
  • You may remove your content at any time, subject to technical limitations
  • Content may be cached or stored in backups for technical reasons

Content Standards and Requirements:

  • All content must be accurate, lawful, and appropriate
  • Professional information must be truthful and verifiable
  • Images and media must not infringe third-party rights
  • Content must comply with applicable laws and industry standards
  • Content must be your own work or properly licensed
  • Content must not contain confidential or proprietary information of others

Content Moderation:

  • We reserve the right to review, edit, or remove content at our discretion
  • Content may be removed for violations of these Terms or applicable law
  • We may use automated systems to detect and remove prohibited content
  • Users may report inappropriate content through our reporting system
  • Content removal decisions may be appealed through our dispute process

7.2 Platform Intellectual Property

DPN Ownership:

  • Our platform, software, trademarks, and proprietary systems remain our exclusive property
  • Users receive a limited, non-exclusive licence to use our services according to these Terms
  • Reverse engineering, copying, or unauthorised use of our platform is prohibited
  • Our brand elements, logos, and design may not be used without written permission
  • All improvements, modifications, and derivative works belong to DPN

Licence Restrictions:

  • You may not sublicense, sell, or transfer your licence to use our services
  • You may not use our services for competitive purposes

  • Commercial use beyond normal platform usage requires separate agreement

Best Efforts Service:

  • We strive to maintain high platform availability and performance
  • Scheduled maintenance may temporarily interrupt services
  • We are not liable for service interruptions beyond our reasonable control
  • Users will be notified of planned maintenance when possible
  • We aim for 99.5% uptime but do not guarantee uninterrupted service
  • Service level agreements may be available for enterprise users

11. DISCLAIMERS AND LIMITATIONS

11.1 Service Disclaimers

  • DPN acts as an intermediary connecting drone professionals with clients
  • We do not provide drone services directly
  • Professional qualifications and service quality are the responsibility of individual service providers
  • We do not guarantee successful matches or transaction outcomes
  • We do not supervise or control professional services
  • All professional relationships are between users

Information Accuracy:

  • While we strive for accuracy, we cannot guarantee the completeness or currency of all platform information
  • Users are responsible for independently verifying professional credentials and capabilities
  • Market information and pricing data are provided for informational purposes only
  • Aviation regulations and requirements may change without notice
  • Third-party information may be inaccurate or outdated
  • Users should verify all information before making business decisions

Service Quality:

  • We do not warrant the quality, safety, or legality of services provided through our platform
  • Professional services are provided “as is” without warranties
  • We disclaim all warranties, express or implied, including merchantability and fitness for purpose
  • Users assume all risks associated with professional services

11.2 Limitation of Liability

Liability Exclusions:

To the fullest extent permitted by law, DPN shall not be liable for:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions or technical malfunctions
  • Actions or omissions of drone professionals or clients using our platform
  • Professional negligence or misconduct
  • Safety incidents or regulatory violations
  • Disputes between users
  • Third-party service failures or interruptions

Maximum Liability:

  • Our total liability for any claim shall not exceed the amount paid by you for our services in the 12 months preceding the claim
  • In no event shall our liability exceed R10,000 (Ten Thousand Rand) for any single incident
  • This limitation applies regardless of the legal theory of liability
  • Some jurisdictions may not allow certain liability limitations
  • These limitations shall apply to the maximum extent permitted by applicable law

11.3 Professional Service Disclaimer

Independent Contractors:

  • Drone professionals on our platform are independent contractors
  • We do not employ, supervise, or control professional service providers
  • Professional relationships and service agreements are between users
  • We are not responsible for the quality, safety, or legality of professional services
  • We do not participate in contract negotiations or dispute resolution between users
  • Users must resolve disputes directly with service providers

11.4 Third-Party Services

  • We are not responsible for third-party services or their availability
  • Third-party terms and conditions apply to their respective services
  • We disclaim responsibility for third-party data practices
  • Links to third-party sites are provided for convenience only

12. INDEMNIFICATION

12.1 User Indemnification

You agree to indemnify, defend, and hold harmless DPN, its officers, directors, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of our platform and services
  • Violation of these Terms or applicable laws
  • Infringement of third-party intellectual property or other rights
  • Professional services provided or received through our platform
  • Any content you post or share on our platform
  • Your interactions with other users
  • Any breach of representations or warranties made by you

12.2 Professional Service Indemnification

Drone professionals additionally agree to indemnify DPN against claims arising from:

  • Aviation regulation violations or safety incidents
  • Professional negligence or service defects
  • Insurance coverage disputes or lapses
  • Misrepresentation of qualifications or credentials
  • Failure to maintain required licences or certifications
  • Breach of professional standards or codes of conduct
  • Damage to client property or personal injury

12.3 Indemnification Process

  • We will notify you promptly of any claims subject to indemnification
  • You may assume control of the defence with counsel of your choice
  • We reserve the right to participate in defence with our own counsel
  • You may not settle claims without our written consent
  • This indemnification survives termination of your account

13. INSURANCE AND LIABILITY

13.1 Professional Insurance Requirements

  • Drone professionals must maintain adequate insurance coverage
  • Coverage must include public liability and professional indemnity
  • Minimum coverage amounts may be specified by jurisdiction
  • Insurance must cover drone operations and related services
  • Proof of insurance may be required for verification
  • Coverage must be maintained throughout the duration of platform use

13.2 Insurance Disclaimers

  • DPN does not provide insurance coverage for user activities
  • Users are solely responsible for obtaining adequate insurance
  • We do not verify insurance coverage beyond initial verification
  • Insurance requirements may vary by jurisdiction and service type
  • Users should consult insurance professionals for appropriate coverage

14. TERMINATION

14.1 Termination by User

Account Deletion:

  • You may delete your account at any time through your account settings
  • Account deletion will remove your profile and personal information
  • Before submitting an account deletion request, you are responsible for resolving any unused credit balance. To request a refund of unused credits, contact us at legal@dronepilotnet.com prior to deletion. Unused credits remaining at the time your account is deleted are forfeited. DPN retains transaction records and DPN Credits logs for a minimum of seven (7) years following deletion, as required by applicable South African law, and these records serve as the basis for any pre-deletion refund claim
  • Some information may be retained for legal or legitimate business purposes
  • 30 days notice is recommended before account deletion
  • Account deletion is irreversible once completed

14.2 Termination by DPN

We may suspend or terminate your account immediately, with or without notice, for:

  • Material breach of these Terms
  • Fraudulent or illegal activity
  • Violation of aviation regulations or safety standards
  • Misrepresentation of credentials or qualifications
  • Abusive or harmful behaviour towards other users
  • Repeated policy violations or warnings
  • Failure to maintain required insurance or licences
  • Conduct that damages our reputation or user trust
  • Non-payment of fees or chargebacks
  • Violation of third-party rights or terms

14.3 Suspension Process

  • Account suspension may be temporary or permanent
  • Suspended users will be notified of the reason and duration
  • Users may appeal suspensions through our dispute resolution process
  • During suspension, account access and features are restricted
  • Credits and data may be preserved during temporary suspensions

14.4 Effect of Termination

Upon termination:

  • Your access to platform services will be immediately revoked
  • If DPN terminates your account without cause, any unused credit balance will be refunded at the standard purchase rate within 30 business days of termination. If your account is terminated by you, or by DPN due to a violation of these Terms, outstanding credit balances will be forfeited without refund
  • Content and data associated with your account may be deleted
  • Pending transactions may be cancelled or completed at our discretion
  • Certain provisions of these Terms will survive termination
  • You remain liable for activities that occurred before termination

14.5 Survival

The following provisions survive termination:

  • Intellectual property rights and licences
  • Indemnification obligations
  • Limitation of liability and disclaimers
  • Dispute resolution procedures
  • Payment obligations and fees

15. DISPUTE RESOLUTION

15.1 Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.

15.2 Jurisdiction

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Western Cape Province, South Africa.

15.3 Dispute Resolution Process

Initial Resolution:

  • Contact our support team first to attempt informal resolution
  • We will work in good faith to address legitimate concerns
  • Most issues can be resolved through direct communication
  • Response will be provided within 5 business days
  • Escalation to senior management is available

Formal Mediation:

  • Unresolved disputes may proceed to mediation
  • Mediation will be conducted by a qualified neutral mediator
  • Mediation costs will be shared equally between parties
  • Mediation is confidential and without prejudice
  • Either party may terminate mediation with 30 days notice

Legal Proceedings:

  • If mediation fails, disputes may proceed to court
  • South African courts shall have exclusive jurisdiction
  • Legal proceedings must be commenced within two years of the dispute arising, except where a longer period is required by the applicable law of the jurisdiction in which you are located
  • The prevailing party may be entitled to reasonable attorneys’ fees

15.4 Class Action and Jury Trial Waiver

To the maximum extent permitted by applicable law:

  • You waive any right to participate in class action lawsuits
  • You waive any right to jury trial in jurisdictions where jury trials are available
  • All disputes must be resolved on an individual basis
  • Collective or representative actions are prohibited

15.5 Emergency Relief

  • Either party may seek emergency injunctive relief
  • Courts may grant temporary restraining orders
  • Emergency procedures do not waive other dispute resolution requirements

16. COMPLIANCE AND REGULATORY MATTERS

16.1 Aviation Compliance

  • Users must comply with all applicable aviation regulations
  • Drone operations must be conducted safely and legally
  • Users are responsible for obtaining necessary permits and approvals
  • Regulatory changes must be promptly incorporated into operations
  • Safety incidents must be reported to relevant authorities
  • We may cooperate with aviation authority investigations

16.2 Professional Standards

  • Professionals must adhere to industry codes of conduct
  • Continuing education and training requirements must be met
  • Professional development should be pursued actively
  • Ethical standards must be maintained at all times

16.3 International Compliance

  • Cross-border services must comply with multiple jurisdictions
  • Export controls and trade restrictions may apply
  • Currency and tax regulations must be observed
  • Data protection laws vary by jurisdiction

17. GENERAL PROVISIONS
